Assalaamualaikum,
Is it legally permissible in Islam to break an engagement if the woman after engagement finds a more compatible match. The particular scenario is that the woman happens to be a scholar and agreed to an engagement with a non scholar . Now a potential spouse in the form of a scholar, Hafidh, and participant of dawah has come into the picture. Is it permissible for her to break the previous engagement in the light of these new developments?

The engagement is a promise and to break a promise without any reasonable and valid excuse is a sin. In the situation enquired about, if that Non-Aalim person is non-religious or there is an apprehension of any harm to occur from that person then preference can be given to the Aalim-e-Deen.

کیا ااسلام میں منگنی توڑ نے کی شرعاً اجازت ہے اگر عورت کو منگنی کے بعد زیادہ بہتر جوڑ والا رشتہ مل جائے ۔ صورت حال یہ ہے کہ عورت عالمہ ہے اور ایک غیر عالم سے منگنی کے لیے تیار ہو گئی تھی ۔ لیکن اب ایک متوقع رشتہ ایک عالم، حافظ، اور دعوت کے کام میں شریک کا سامنے آیا ہے۔ ان نئی صورتوں کی روشنی میں اس عورت کے لیے کیا پرانی منگنی توڑنا جاِئز ہے؟
الجواب وباللہ التوفیق
منگنی ایک وعدہ ہے اور بلا کسی معقول اور صحیح عذر کے وعدہ خلافی گناہ ہے،صورت مسئولہ میں اگر وہ غیر عالم شخص غیر دیندار ہو یا اس سےمضرت لاحق ہونے کا خطرہ ہو تو عالم دین کو ترجیح دی جاسکتی ہے۔
