Kufr/Disbelief

Assalamualikum,

 
Mere shohar  raat me bahut late night job karke thakay hue aye thay. Fajr shuru hone se pehle utkar Isha ki witr baqi reh gayi thi tuo witr parhe uske baad mai unse poochi "kiya aap Fajr ki jammat ku jaainge kiya."
 
Unoo bole ke aisa sawal mat karo jis se admi inkar kare aor baaz waqt kufr tak pahunch jaye. Ispar main unse boli ke namaaz ka inkar karne se kufr hota magar isme namaz ka inkar nahi hai isme tuo jammat se parhne ki baat horahi hai. Agar thakey hue hain tuo aap ye bol sakte ke main jana chahroun magar thaka hua hoon ghar me hee parh loonga ye inkar nahi hai isse kufr nahi hota.
 
Hamare beech bahas hui aor unoo kuch bole jo ab mujhe pakka yaad nahi hai. Ghaliban woh ye bole "aisa tuo phir ham ab tak kafir hogay." (mereku ye unka jumla pakka yaad nahi hai magar 99% gumaan hai yahi bole.)
 
Adhey ghanta ke baad mai unku samjhane ke liye boli ke aap aisa jumla nahi bolna chahiye tha masla maloom karo. Ispar unoo ghussey mein bole "main kafir hoon"
Ye sirf unoo ghussey mein bole waise tuo shariat ki pabandi karte hai Alhamdulillah.
 
Aap iska masla bataiye ke hamara nikah toot gaya hai kiya? 
Agar toot gaya tuo kiya karna chahiye?

It is a severe sin and an extremely abominable action to leave salah on purpose however by doing so the person does not become a kafir(disbeliever).

However by stating “mai kafir hoon” constitutes kufr(disbelief) thus your husband has become a kafir. He should perform istaghfar, repent abundantly, renew his faith in Islam and renew his Nikah with you.
